3. Eligibility

To use the Services, you must be at least 18 years old, or the age of legal majority in your jurisdiction, and capable of forming a binding contract. If you are accessing the Services on behalf of a healthcare organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4. Account Registration

To access certain features of our Services, you must register for an account. When you register, you agree to:

  • Maintain and promptly update your account information
  • Maintain the security of your account, including keeping your password confidential

As a healthcare provider using our Services, you represent and warrant that:

  • You are qualified and licensed to provide the medical services you offer
  • You will maintain accurate and current professional credentials on the platform
  • You will keep accurate records of patient appointments and treatments
  • You will use the platform in accordance with applicable healthcare laws and regulations
  • You will maintain patient confidentiality and privacy

6. Appointment Booking and Cancellation

Our Services allow patients to book appointments with healthcare providers. The following terms apply to appointment booking:

  • Appointments are subject to healthcare provider availability
  • Patients should arrive on time for their appointments
  • Cancellations should be made at least 24 hours in advance when possible
  • Repeated no-shows or late cancellations may result in restrictions on future bookings
  • Healthcare providers should maintain their availability calendar and promptly update any changes

7. Content and Data

You retain ownership of any Content you submit to the Services. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such Content in connection with providing and improving the Services.

We take no responsibility and assume no liability for Content posted by you or any third party.

8. Privacy

Our Privacy Policy, available at https://mypulse.com/privacy, describes how we collect, use, and share information about you when you use our Services. By using our Services, you agree to the collection, use, and sharing of your information as described in the Privacy Policy.

9. Intellectual Property

The Services and their contents, features, and functionality, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software, are owned by MyPulse or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as permitted by these Terms.

10. Limitation of Liability

To the maximum extent permitted by applicable law, MyPulse and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:

  • Your use of or inability to use the Services
  • Any changes made to the Services
  • Unauthorized access to or use of our servers and any personal information stored therein
  • Any medical advice, treatment, or services received through or as a result of the Services
  • Any third-party communications, or Content posted, transmitted, or made available via the Services

11. Disclaimer of Warranties

The Services are provided "as is" and "as available," without warranty of any kind, either express or implied. Without limiting the foregoing, we explicitly disclaim any warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement, and any warranties arising out of course of dealing or usage of trade.

We make no warranty that the Services will meet your requirements, be available on an uninterrupted, secure, or error-free basis, or be accurate, reliable, complete, legal, or safe.

12. Indemnification

You agree to indemnify, defend, and hold harmless MyPulse and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all losses, damages, liabilities, deficiencies, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising from or relating to:

  • Your use of and access to the Services
  • Your violation of these Terms
  • Your violation of any rights of another
  • Your Content or information provided to us

13. Term and Termination

These Terms will remain in full force and effect while you use the Services. We may terminate or suspend your access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Any dispute arising from or relating to these Terms or your use of the Services shall first be resolved through good faith negotiations. If such negotiations fail, the dispute shall be resolved through arbitration in accordance with the rules of the American Arbitration Association, and judgment on the award may be entered in any court having jurisdiction.
